Terms of Service
1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between MAWG3 Inc. ("MAWG3", "we", "us") and the person or business that accesses or uses our website-building, commerce, hosting, administration, artificial-intelligence, and related services (collectively, the "Service"). By creating an account, selecting a paid plan, or using the Service, you accept these Terms and the policies expressly incorporated into them. If you use the Service for a business or other entity, you confirm that you have authority to bind it. If you do not agree, do not use the Service.
2. Eligibility and Business Authority
You must have legal capacity under the laws applicable to you. An individual who lacks full legal capacity may use the Service only through a legally authorised representative. If you operate a store, you must hold and maintain every commercial licence, approval, registration, and permit required for your activities in Kuwait or any other market you serve. You are responsible for determining whether the Service is suitable for your business and for complying with sector-specific rules.
3. Accounts and Account Security
You must provide accurate, complete, and current account and billing information. You are responsible for your password, authorised staff accounts, permissions, and all activity under your account. Keep credentials confidential, use appropriate security controls, and notify us promptly at [email protected] if you reasonably suspect unauthorised access. We may rely on instructions given through an authenticated account. You remain responsible for former staff or agents until their access is removed.
4. The MAWG3 Service
MAWG3 supplies tools for creating and operating websites and online stores, including storefronts, product catalogues, checkout, order administration, sales channels, analytics, integrations, and optional AI features. MAWG3 provides technology; unless we expressly say otherwise in writing, we are not the seller, buyer, payment institution, delivery company, marketplace party, employer, or agent in a transaction between a merchant and its customer. We may improve or change features while preserving any rights that cannot lawfully be excluded.
5. App Stores and Mobile Applications
The Service includes our merchant applications for iOS and Android. These Terms, and not the terms of any app store, govern your use of those applications, and this agreement is between you and MAWG3 Inc. only. Apple Inc. and Google LLC are not parties to it. They have no obligation to provide maintenance or support for our applications, and they are not responsible for any claim relating to them, including product liability, consumer protection, or intellectual-property claims. If an application fails to conform to an applicable warranty, you may notify the relevant app store, which may refund the purchase price where its rules provide for one; beyond that it has no further warranty obligation. You confirm that you are not located in a country subject to an applicable embargo and are not on a restricted-party list. Apple Inc. and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
6. Merchant Responsibilities and Kuwait Compliance
You are the merchant of record for sales through your store and are solely responsible for your products, descriptions, prices, stock, promotions, licences, invoices, customer disclosures, customer service, delivery, returns, refunds, warranties, and regulatory compliance. Information shown to customers must be accurate and not misleading. You must comply with Kuwait Consumer Protection Law No. 39 of 2014, its executive regulations, Kuwait Electronic Transactions Law No. 20 of 2014, applicable Ministry of Commerce and Industry requirements, and any other law governing your goods, services, advertising, or customers. Mandatory consumer rights always prevail over inconsistent store policies.
7. Customer Orders, Fulfilment, and Refunds
A customer order is a transaction between you and the customer. You decide whether to accept or cancel it and are responsible for fulfilment, shipping or pickup, proof of delivery, customer communications, returns, refunds, chargebacks, and complaints. You must publish clear contact, delivery, cancellation, exchange, and refund information and honour it, subject to mandatory Kuwaiti consumer law. MAWG3 may provide administration tools, but does not guarantee customer identity, payment, delivery, or performance by either party.
8. MAWG3 Fees, Billing, and Taxes
Paid plans and add-ons are billed at the price, currency, and interval displayed when you subscribe. Unless stated otherwise, subscription fees are charged in advance and renew automatically until cancelled. You authorise us and our payment providers to charge your selected method. You must keep a valid payment method and pay applicable fees and taxes. Fees are non-refundable except where the plan states otherwise or the law requires a refund. We may change future pricing after reasonable notice; a change applies from a later renewal date. Overdue amounts may result in restricted or suspended access.
9. Payments, Domains, and Third-Party Services
Payment gateways, banks, card networks, domain registrars, delivery providers, apps, and other integrations are independent third parties governed by their own terms and privacy practices. Their availability, approval, fees, settlement times, reversals, and performance are outside our control. You authorise MAWG3 to exchange the information reasonably required to provide an integration you enable. You are responsible for reviewing third-party terms and maintaining any required account. MAWG3 is not responsible for a third party except to the extent liability cannot be excluded by Kuwaiti law.
10. MAWG3 Intellectual Property
The Service, including its software, interface, design systems, templates, documentation, trademarks, and original content, is owned by or licensed to MAWG3 and protected by applicable intellectual-property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your lawful business purposes. You may not copy, sell, sublicense, scrape, bypass, reverse engineer, or create a competing service from protected parts of the Service except where such restriction is prohibited by law.
11. Your Content and Store Data
You retain ownership of content and data you submit to the Service. You grant MAWG3 and its service providers a non-exclusive, worldwide licence to host, reproduce, process, transmit, adapt for technical formatting, display, and back up that content only as reasonably necessary to provide, secure, support, and improve the Service or comply with law. You confirm that you have all rights and permissions needed for your content, including product images, customer information, trademarks, reviews, and marketing materials. You are responsible for the legality, accuracy, and backup of your content.
12. Privacy, Personal Data, and Security
Each party must comply with applicable privacy and data-protection requirements, including the current data-privacy rules issued by Kuwait’s Communication and Information Technology Regulatory Authority where applicable. Our Privacy Policy explains how MAWG3 handles personal data. For customer data you collect through your store, you determine the lawful purpose and instructions and remain responsible for notices, permissions, retention, access requests, and marketing compliance. We use reasonable safeguards, but no online service is completely secure; you must configure access and security settings appropriately and notify us promptly of suspected incidents.
13. AI and Automated Features
Optional AI features, including Barq AI, may generate text, suggestions, actions, or other output from your instructions and store context. Output may be incomplete, inaccurate, or unsuitable and must be reviewed before publication or business use. You remain responsible for instructions, approvals, resulting store changes, and compliance with law. Do not submit sensitive information unless necessary and authorised. Actions that change your store are shown to you for confirmation and apply only when you confirm them. MAWG3 does not guarantee that AI output is unique or that similar output will not be provided to others.
14. Acceptable Use and Prohibited Activities
You may not use the Service to break Kuwaiti law or the law of a market you serve; sell prohibited, counterfeit, stolen, unsafe, or unlicensed goods or services; deceive consumers; violate public order or intellectual-property, privacy, or publicity rights; distribute malware, spam, phishing, or harmful code; facilitate fraud or unauthorised payments; exploit or test security without permission; interfere with the Service; evade limits or fees; impersonate another person; or use automated extraction or the Service to build a competing product. We may investigate suspected abuse and cooperate with lawful requests from competent authorities.
15. Availability, Changes, and Beta Features
We aim to provide a reliable Service but do not promise uninterrupted or error-free operation. Maintenance, security events, telecommunications failures, third-party services, legal requirements, or events outside reasonable control may affect availability. We may add, modify, or discontinue features and may apply reasonable usage or technical limits. Where a change materially reduces a paid core feature, we will provide reasonable notice when practicable. Preview, beta, or experimental features may change or be withdrawn and are used at your risk.
16. Suspension, Cancellation, and Termination
You may cancel a subscription through the available account controls; cancellation normally takes effect at the end of the current paid period. We may restrict, suspend, or terminate access for non-payment, breach, security risk, unlawful conduct, harm to users or the Service, or when required by a competent authority. When reasonably possible, we will give notice and an opportunity to remedy. After termination, storefront access may end and content may be deleted according to our retention practices. Export content before cancellation. Terms that by nature should survive termination will remain effective.
17. Disclaimers
To the fullest extent permitted by Kuwaiti law, the Service is provided on an “as available” basis. MAWG3 does not warrant that the Service will meet every business need, produce any level of sales, preserve every item of data, or make your store legally compliant. Advice, analytics, translations, templates, and AI output are tools and are not legal, tax, accounting, or other professional advice. Nothing in these Terms excludes a warranty, consumer right, or duty that cannot lawfully be excluded.
18. Limitation of Liability
To the maximum extent permitted by Kuwaiti law, MAWG3 is not liable for indirect, incidental, special, exemplary, or consequential loss, or for lost profits, revenue, business, goodwill, opportunities, or data arising from the Service, third-party services, or merchant-customer transactions. MAWG3’s aggregate liability arising from the Service will not exceed the fees you paid to MAWG3 for the Service during the twelve months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited, including liability resulting from fraud, wilful misconduct, or any other non-excludable obligation.
19. Your Responsibility for Claims
To the extent permitted by Kuwaiti law, you will defend and compensate MAWG3 and its personnel against third-party claims, losses, penalties, and reasonable costs arising from your store, products, content, customer transactions, breach of these Terms, infringement of another person’s rights, or violation of law. This obligation does not apply to the extent a claim was caused by MAWG3’s own breach, negligence, fraud, or wilful misconduct. We will give reasonable notice of a covered claim and allow you to participate in its defence.
20. Governing Law and Kuwait Courts
These Terms and any non-contractual obligations connected with them are governed by the laws of the State of Kuwait, without prejudice to any mandatory protections that apply. The courts of the State of Kuwait have exclusive jurisdiction over disputes arising from or connected with the Terms or Service. Before filing a claim, each party should send written notice describing the dispute and allow thirty days for a good-faith attempt to resolve it, unless urgent relief or a legal deadline requires earlier action.
21. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, security, or business practices. We will post the revised Terms and update the date above. For a material change, we will provide reasonable advance notice through the Service or the contact details associated with your account when practicable. Changes do not apply retroactively unless required by law. Continuing to use the Service after the effective date constitutes acceptance; if you do not agree, you must stop using the Service and cancel any subscription.
22. General Provisions
Electronic notices and records may be used as permitted by Kuwait Electronic Transactions Law No. 20 of 2014. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganisation, financing, or transfer of the relevant business, subject to law. Delay in enforcing a right is not a waiver. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. These Terms and incorporated policies are the entire agreement concerning the Service and replace prior discussions on the same subject.
